Settling matters outside of court has many advantages over litigating them in court. However, sometimes litigation is the only means of protecting your legal interests, moving your case forward, or resolving it. With litigation, the emphasis is on persuading a judge, court commissioner, or arbitrator that the law favors your position over that of the other party’s position.

From the start of representation, we always keep in mind the possibility that an issue or entire case might need to be litigated. As such, from the beginning, we prepare a case as though it might be litigated. In this way, if settlement negotiations break down or are not initially feasible–and a quick turnaround on an issue is needed–we can move rapidly to insure that the court resolves the issue in a timely manner.
